Конфискация имущества в континентальной и англосаксонской правовых традициях опирается на несовпадающие процессуальные конструкции, что осложняет прямое заимствование зарубежных механизмов отечественным законодателем. Расхождение проявляется в том, против кого направлено производство, какой стандарт доказывания применяется и требуется ли обвинительный приговор для изъятия имущества. Цель работы состоит в установлении структурных параметров, разграничивающих две модели, и в оценке условий, при которых отдельные элементы англосаксонского подхода совместимы с континентальными процессуальными гарантиями. Применены формально-юридический, сравнительно-правовой и историко-правовой методы, а также метод правового моделирования; эмпирическую основу составили уголовное законодательство России, США, Великобритании и Германии в действующих редакциях и акты высших судов. Установлено, что англосаксонская гражданская конфискация in rem с пониженным стандартом доказывания не имеет процессуального аналога в континентальной модели, привязанной к обвинительному приговору и презумпции невиновности. Сближение правопорядков идёт не через рецепцию производства против вещи, а через развитие расширенной и независимой от приговора конфискации внутри континентальных систем, оформленное германской реформой 2017 года и Директивой ЕС 2024/1260. Отсюда следует, что заимствование англосаксонского опыта в российском праве ограничено не техническими, а конституционно-процессуальными причинами и продуктивно лишь в части, не затрагивающей перенос бремени доказывания на обладателя имущества.
Confiscation of property in the continental and Anglo-Saxon legal traditions rests upon dissimilar procedural constructions, which complicates the direct borrowing of foreign mechanisms by the domestic legislator. The divergence manifests itself in whom the proceeding is directed against, what standard of proof is applied, and whether a conviction is required for the seizure of property. The aim of the study is to establish the structural parameters that distinguish the two models and to assess the conditions under which particular elements of the Anglo-Saxon approach are compatible with continental procedural guarantees. The formal-legal, comparative-legal and historical-legal methods were applied, together with the method of legal modelling; the empirical basis was formed by the criminal legislation of Russia, the United States, the United Kingdom and Germany in their effective wordings and by the acts of the higher courts. It was established that Anglo-Saxon civil forfeiture in rem with its lowered standard of proof has no procedural counterpart in the continental model, which is tied to a conviction and to the presumption of innocence. The convergence of the legal orders proceeds not through reception of the proceeding against the thing, but through the development of extended and conviction-independent confiscation within continental systems, formalised by the 2017 German reform and by Directive (EU) 2024/1260. It follows that the borrowing of Anglo-Saxon experience in Russian law is constrained by constitutional and procedural rather than technical reasons, and is productive only in the part that does not shift the burden of proof onto the holder of the property.
